Terms and Conditions

These terms are the agreement between you and Going Somewhere. They cover our website at https://goingsomewhere.app and the Going Somewhere app on mobile, tablet and desktop — together, the Services. By using the Services you accept them; if you do not, please do not use the Services.

Going Somewhere is a shared packing checklist. You create a trip, invite the people coming with you, and organise what needs packing into groups. Each item has a status (to buy, ready to pack, packed), can be assigned to someone, and can carry a note and a storage location. Everything on a trip is visible to everyone on that trip — that is the point of the app.

SUMMARY OF KEY POINTS

What does it cost? Nothing while we are in beta, with no limit on how many trips you create. After beta there will be a free tier with a limit on new trips, and a one-off payment to remove it — see section 8. Trips you have already made stay yours, and we will not put them behind a payment.

Who owns what you write? You do. Your trips, groups, items and notes are yours. You give us only the permission we need to store them and show them to the people you invited.

Who can see your trips? Everyone on that trip, and anyone holding its share link. Treat a share link as you would a key.

Can you leave? Yes, at any time, from the app. Deleting your account deletes your trips — see section 6.

What do we promise? That we will run the service with reasonable care. We do not promise it will never be unavailable, and it is not a safety-critical system — do not rely on it for anything that matters more than a packing list.

Who is this for? Adults. You must be 18 or over to use the Services.

1. WHO WE ARE, AND THESE TERMS

In Short: We are Going Somewhere. Using the Services means accepting these terms.

Going Somewhere ('we', 'us', 'our') provides the Services described above. These terms, together with our Privacy Policy, form the agreement between us. The Privacy Policy explains what we do with your personal information and is part of this agreement.

Nothing in these terms limits your rights as a consumer under the law of the country you live in. Where a term here conflicts with a right you have that cannot be signed away, that right wins.

2. WHO CAN USE THE SERVICES

In Short: Adults, using it for their own trips.

You must be 18 or over. We do not knowingly allow anyone younger to create an account, and we do not ask your age, so we rely on you being straight with us.

The Services are for organising your own travel, with the people you are travelling with. You are welcome to use it for a trip you are being paid to organise. What you may not do is resell it, rebrand it, or build a competing product out of it — see section 5.

3. YOUR ACCOUNT

In Short: No passwords. Look after the inbox the codes go to.

Going Somewhere has no passwords. You sign in by giving us an email address; we email you a six-digit code, and entering it signs you in for 30 days on that device.

That means your email account is the key to your Going Somewhere account. Anyone who can read your inbox can sign in as you. Keep it secure, and tell us at help@goingsomewhere.app if you think somebody else has access to your trips.

You choose a display name, which the other people on your trips can see. Keep it something you would be happy for them to read; we may change a name that is abusive or impersonates somebody else.

You are responsible for what happens under your account.

4. YOUR TRIPS AND WHAT YOU PUT IN THEM

In Short: Your content stays yours. Everyone on a trip can see all of it.

It is yours. Trip names, groups, items, notes, storage locations — everything you write stays yours. We claim no ownership of it.

What you allow us to do with it. So that we can actually run the service, you give us permission to store your content, back it up, and show it to you and to the other members of that trip. That permission lasts as long as the content does and no longer: delete it, or delete your account, and it ends. We will not sell it, publish it, or use it to advertise to anybody.

Everyone on the trip sees everything. Items, statuses, assignments, notes and the display names of everyone involved are visible to every member of that trip. A trip's share link lets anyone holding it join and see the same. Only share it with people you mean to invite.

Notes are free text, and we do not read them. Whatever you type is stored as you typed it. Do not put anything in a packing list that you would not want the other people on that trip to read.

What you must not put in. Do not upload anything unlawful, or anything you do not have the right to share. Do not use somebody else's personal information without a reason to. If you invite somebody by email address, use one you were given for that purpose.

Feedback. If you send us a suggestion or an idea about the Services, we may act on it and build it, without owing you anything for it. That applies to feedback you send us — not to the contents of your trips.

5. WHAT YOU MAY NOT DO

In Short: Do not attack the service, and do not resell it.

You agree not to:

  • break the law with it, or use it to harm, harass or impersonate anybody;
  • try to get into accounts, trips or data that are not yours;
  • probe, scan, overload or interfere with the Services or the systems they run on, or work around any limit or security measure;
  • scrape the Services, or use bots or scripts to create accounts or extract content in bulk;
  • copy, decompile or reverse engineer our software, except where the law says you may;
  • resell, rent out, rebrand or redistribute the Services, or use them to build a competing product; or
  • remove or obscure any notice of ownership on anything we provide.

If you break these terms we may suspend or close your account — see section 6.

Finding a security flaw is not a breach of these terms. Report it to help@goingsomewhere.app and give us a reasonable chance to fix it before telling anyone else, and we will treat you as having done us a favour.

6. ENDING IT

In Short: Leave whenever you like. We will only close your account for a reason.

You. Delete your account from your profile in the app, whenever you want, without asking us. Trips where you were the only member are deleted with it. Trips shared with other people remain, because they are theirs too: items you added go with your account, and items others added that you were assigned or had packed stay on the list with those fields cleared.

Us. We may suspend or close an account that is breaking these terms, breaking the law, or putting the Services or other people at risk. Unless the law stops us or the situation makes it pointless, we will tell you why and give you a chance to put it right first. If we close your account and you think we got it wrong, reply to us and a person will look at it again.

Afterwards. Sections 4 (what is yours), 9 (promises and liability), 12 (law and disputes) and 13 (odds and ends) carry on applying after your account has gone.

7. OUR SOFTWARE AND OUR BRAND

In Short: We built it, you may use it, you may not take it apart or take it over.

The Services, their software, design, text and the Going Somewhere name and logo belong to us or to the people who licensed them to us. Nothing here transfers any of that to you.

We give you a personal, non-exclusive, revocable licence to use the Services — including to install the app on devices you own or control — for as long as you keep to these terms. That is all it is: a permission to use the thing, which we can withdraw if you break these terms.

Where you install the app from an app store, that store's own terms also apply to the installation, and the store is not responsible for the app, its content, or supporting it. We are.

8. PAYING FOR IT

In Short: Free and unlimited while we are in beta. After that, a limit on new trips unless you pay once — and the trips you already have stay yours either way.

While we are in beta. Going Somewhere is free, with no limit on how many trips you create. We will tell you in the app before beta ends, and before any limit or charge starts to apply.

After beta. There will be a free tier with a limit on how many trips you can create, and a single one-off payment that removes that limit for good. It is not a subscription: you pay once, it does not renew, and it does not expire.

What the limit never does. It applies to creating new trips, and nothing else. Trips you have already created stay readable and editable whether you pay or not, and trips other people invited you to do not count against it. We will not put a trip you already made behind a payment, and we will not delete one because you have not paid.

Buying it. Where you use the app from Apple's App Store or Google Play, the payment is taken by that store under its own terms rather than by us, and that store handles refunds. The price is shown before you buy and includes any tax due.

If the price changes. We may change what the unlock costs, or what the free tier includes. Neither affects a purchase you have already made: once you have paid, you keep unlimited trips.

Cancelling. As a consumer you normally have 14 days to cancel a purchase of digital content. Because the unlock takes effect the moment you buy it, you may be asked to agree to immediate delivery at that point, which ends the right to cancel once it has been delivered. Nothing here removes a refund the law entitles you to, or one the app store decides to give you anyway.

If we stop selling it. If we withdraw the paid unlock, or stop offering the Services altogether, we will give reasonable notice in the app — see section 11.

9. WHAT WE PROMISE, AND WHAT WE DO NOT

In Short: We will run it with reasonable care. It is a packing list, not a safety net.

We will provide the Services with reasonable care and skill. Beyond that, we provide them as they are.

We do not promise that the Services will always be available, that they will be free of faults, or that anything on them is complete or accurate — including anything the "Forgotten anything?" feature suggests, which is a prompt to think, not advice to rely on. It is your responsibility to check you have what you actually need for your trip. Do not use Going Somewhere as the only record of anything that matters — medication, documents, or anything with a consequence attached.

We keep backups, but you should not treat the Services as the only copy of anything important.

Liability. We are responsible to you for loss we cause by breaking this agreement or by failing to use reasonable care — but not for loss that was not foreseeable when you started using the Services, and not for business losses, since the Services are supplied for personal use. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit. Subject to that, our total liability to you is limited to £100, or to what you have paid us, whichever is the greater.

If you have paid for the unlock in section 8, you also have the rights the law gives a buyer of digital content — that it is of satisfactory quality, fit for purpose and as described. Nothing in this section takes those away.

If you break these terms and that causes a third party to bring a claim against us, we may ask you to cover what it reasonably costs us to deal with it.

10. PRIVACY

In Short: Read the Privacy Policy. It is short and it is honest.

What we collect and who else sees it is set out in the Privacy Policy, which forms part of this agreement.

We are based in the United Kingdom, and the suppliers who run the Services on our behalf are named in the Privacy Policy, along with the countries their systems operate in.

11. CHANGES TO THE SERVICES AND TO THESE TERMS

In Short: Both can change. We will tell you when it matters.

The Services will change: features get added, altered and sometimes removed. We may stop offering them altogether. We will give reasonable notice in the app before removing something you rely on or withdrawing the Services, unless we have to act immediately for legal or security reasons.

We may update these terms. The date at the top always says which version is current. If a change materially affects you, we will tell you in the app before it takes effect. Carrying on using the Services after that means you accept the new version; if you would rather not, delete your account.

What the Services cost, and what the free tier includes, is set out in section 8. If we change either, we will publish the new terms before they take effect and tell you in the app. A change will never take away a trip you have already created, or an unlock you have already paid for.

12. LAW AND DISPUTES

In Short: English law, and the ordinary courts.

These terms are governed by the law of England and Wales.

If something goes wrong, email help@goingsomewhere.app first — nearly everything can be sorted out that way, and we will reply.

If it cannot be, you and we agree that the courts of England and Wales deal with it. If you live in Scotland or Northern Ireland you may bring proceedings there, and if you live elsewhere in the EU you keep the right to bring proceedings in your own country and to rely on the consumer protections of its law. You do not give up any right to go to court by agreeing to these terms.

If you live in California and a complaint to us is not resolved to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone on (800) 952-5210 or (916) 445-1254.

13. ODDS AND ENDS

In Short: The usual small print, kept short.

These terms, with the Privacy Policy, are the whole agreement between us about the Services.

If part of them turns out to be unenforceable, the rest still stands.

If we do not enforce something straight away, we have not given up the right to enforce it later.

We may transfer this agreement to somebody else if our business is sold, but not in a way that reduces your rights. You may not transfer it without asking us.

Nobody other than you and us can enforce these terms.

Neither of us is responsible for a failure caused by something genuinely outside our control.
